<idAbs>The ANCSA 17(b) Easement dataset represents spatial location and basic information about 17(b) easements within the state of Alaska. ANCSA 17(b) easements are rights reserved to the United States in accordance with 43 CFR 2650.4-7 Public easements. They are reserved to provide access to public lands or major waterways. Most often, these reservations are transportation easements including: 60-foot wide existing roads, 100-foot wide proposed roads, and 25- and 50-foot existing and proposed trails. Site easements and miscellaneous easement may include aircraft landings, vehicle parking, temporary camping, and loading and unloading areas. These rights are reserved when the BLM conveys land to a Native corporation under the Alaska Native Claims Settlement Act (ANCSA).</idAbs>
<idPurp>These data can be used to assist the public in understanding where and how they can access public lands across conveyed native lands. Agencies and government entities can utilize the data for on-the-ground management of the easements. Data may also be used for land planning. This data may not accurately represent physical features and should not be used as such.</idPurp>

Accuracy is reviewed and improved, if possible, through coordination with the land owner over which lands the easement is reserved. ANCSA 17(b) easements have been reserved since the early 1970s on large scale USGS Quad Maps, often with felt-tip marker drawn to depict 25′ and 50′ existing and proposed trails, 60′ existing roads, and 100′ proposed roads. The nomination and reservation process did not require the easements to be surveyed, nor did it require on the ground location. Because the purpose of the easement was to preserve public access to public lands after lands have been conveyed out of Federal ownership, there were many instances where easements were reserved for a proposed trail or road to be built. The user must understand that while the digitized line now has a spatial reference, it may not be were the trail is in use on the ground. No alteration of the digitized line may occur unless a MOA with the land owner is processed and approved by BLM Alaska.</measDesc>

Resolution to this issue will be one of two ways depending on how far off the depiction of the easement is from the actual location of the access. If the easement depiction of the map changes, but the description of the easement in the Interim Conveyance (IC) or patent remains unchanged, then the easement location can be adjusted with a Recordable Memorandum of Agreement between the BLM, the Land Owner, and the Administering Agency (if applicable). If the easement description of the IC or patent is altered by a change in the map depiction, either by a legal land description change (for example the trail started in Sec. 1 and now starts in Sec. 2), or by a topographical description change (for example an easement goes to the west of the mountain, and now runs to the east), an easement exchange will be required. This is a formal title action that requires the BLM to follow all acquisition requirements in accepting the donation of a new easement in order for the termination of the existing easement. When easement corrections are made, thru either the MOA process or the easement exchange, the level of accuracy of the easements will greatly increase. As GPS data becomes available, this data will be reviewed to determine if the line work mirrors the reserved easement and the feature’s Coord_Source attribute will reflect that the data was acquired via GPS. If the GPS line does not mirror the easement reserved, a MOA or easement exchange is required prior to altering the line work to reflect the more accurate data collection method. This dataset will never be complete. Over time, the land entitlement will be met for Native Corporations and the ability to initially reserve easements at conveyance will end. However, there will continue to be work after the lands convey to address easement usability and compatibility needs.</stepDesc>
