ANCSA 17(b) easements are rights reserved to the United States in accordance with 43 CFR 2650.4-7 Public easements. They are reserved to provide access to public lands or major waterways. Most often, these reservations are transportation easements including: 60-foot wide existing roads, 100-foot wide proposed roads, and 25- and 50-foot existing and proposed trails. Site easements and miscellaneous easement may include aircraft landings, vehicle parking, temporary camping, and loading and unloading areas. These rights are reserved when the BLM conveys land to a Native corporation under the Alaska Native Claims Settlement Act (ANCSA). These data can be used to assist the public in understanding where and how they can access public lands across conveyed native lands. Agencies and government entities can utilize the data for on-the-ground management of the easements. Data may also be used for land planning. This data may not accurately represent physical features and should not be used as such. ANCSA 17(b) easements have been reserved since the early 1970s on large scale USGS Quad Maps, often with felt-tip marker drawn to depict 25′ and 50′ existing and proposed trails, 60′ existing roads, and 100′ proposed roads. The nomination and reservation process did not require the easements to be surveyed, nor did it require on the ground location. Because the purpose of the easement was to preserve public access to public lands after lands have been conveyed out of Federal ownership, there were many instances where easements were reserved for a proposed trail or road to be built. There are many instances where the easement was reserved in a location that does not properly depict the location of the trail or road the easement intended to reserve the right to access. When the easement does not align with the trail or road where the access is occurring, the users of the road and trail are technically in trespass on the Native Corporation lands. All .tif files have been georeferenced then mosaicked for statewide coverage (were applicable) for ANCSA 17(b) Easement coverage prior to the digitization process. Source input layers were USGS Quad maps with hand drawn or AutoCAD ANCSA 17(b) Easement lines that were converted to .tif files. The easement lines were then digitized in the ArcGIS Environment using the centerline at a scale of 1:3000 with coverage over the entire State of Alaska were applicable. The user must understand that while the digitized line now has a spatial reference, it may not be were the trail is in use on the ground. No alteration of the digitized line may occur unless a MOA with the land owner is processed and approved by BLM Alaska. Resolution to this issue will be one of two ways depending on how far off the depiction of the easement is from the actual location of the access. If the easement depiction of the map changes, but the description of the easement in the Interim Conveyance (IC) or patent remains unchanged, then the easement location can be adjusted with a Recordable Memorandum of Agreement between the BLM, the Land Owner, and the Administering Agency (if applicable). If the easement description of the IC or patent is altered by a change in the map depiction, either by a legal land description change (for example the trail started in Sec. 1 and now starts in Sec. 2), or by a topographical description change (for example an easement goes to the west of the mountain, and now runs to the east), an easement exchange will be required. This is a formal title action that requires the BLM to follow all acquisition requirements in accepting the donation of a new easement in order for the termination of the existing easement. When easement corrections are made, thru either the MOA process or the easement exchange, the level of accuracy of the easements will greatly increase. As GPS data becomes available, this data will be reviewed to determine if the line work mirrors the reserved easement and the feature’s Coord_Source attribute will reflect that the data was acquired via GPS. If the GPS line does not mirror the easement reserved, a MOA or easement exchange is required prior to altering the line work to reflect the more accurate data collection method. This dataset will never be complete. Over time, the land entitlement will be met for Native Corporations and the ability to initially reserve easements at conveyance will end. Easement_ID This is a concatenation of the Quad that the easement(s) lies within and the EIN (refer to the EIN attribute definition for more information about the EIN). This field is used in the editing process, it is the only way to tell the difference between easements that were given the same EIN number on a different quads. In geology or geography, the word "quadrangle" usually refers to a United States Geological Survey (USGS) 7.5-minute quadrangle map, which are usually named after a local physiographic feature. In this example, ILID4_30aC5D1, the first five letters indicate the referenced Quad – Iliamna D4 and the last half after the underscore, 30aC5D1, is the specific EIN within the quad. This field is auto-generated through a model after versions are checked in. The purpose of this field is for analysis at a later time. Concatenation of the Quad that the easement lies within and the EIN. Conveyance_Doc_Type A Conveyance Document is a written instrument which passes legal title to real property from one party to another. The “Conveyance Document Type” for reserving 17(b) easements is though ICs, or an “Interim Conveyance” which is used when the land is conveyed prior to survey. If the land has been surveyed, it will then be listed as “PA” or “Patent”. Lands transferred by IC will receive a patent with a unique patent number once the survey is complete. This is populated manually to indicate the status of the easement. Easement_17b_Conveyance_Doc_Type ANCSA 17(b) Easement Spatial Data Standard Conveyance_Doc_No A Conveyance Document Number is a number assigned to the Conveyance Document for cataloging and future reference for identification. The Conveyance Document transfers the land out of Federal ownership. Conveyance Document Number Easement_Status Easement Status is a reference to how the easement was established, or, in the case of “Nominated”, it is only identified to be established should the land convey. “Easement Status” is different from “Easement type”. Easement_17b_Status ANCSA 17(b) Easement Spatial Data Standard Easement_Category Subtype code and category of: 1. Transportation, 2. Site, and 3. Miscellaneous, that when selected, trigger the domain values for Easement_Type. This is used to quickly populate the associated input Easement_type for the person doing edits. Easement_Category ANCSA 17(b) Easement Spatial Data Standard Easement_Type Transportation easements can generally be described as trails and roads which are reasonably necessary to guarantee the public's ability to reach publicly owned lands or major waterways across lands conveyed to Native corporations. Site easements can be thought of as site specific, i.e. areas for aircraft landings, vehicle parking, temporary camping, and loading and/or unloading of boats, ATVs or other off road transportation. Miscellaneous easement are reserved to allow certain continued use of publicly owned lands and major waterways.
